How to Use Dual Prepositions in German Most German prepositions are always  followed by the same case, but dual prepositions (also called two-way or doubtful prepositions) are prepositions that can take either the accusative or dative case. What Are the Dual Prepositions in German? There are nine of these dual  prepositions: anaufhinternebeninà ¼beruntervorzwischen How to Decide Whether A Dual Preposition Is Dative or Accusative? When a dual preposition answers the question where to? (wohin?) or what about? (worà ¼ber?), it takes the accusative case. When answering the question where (wo?), it takes the dative case.   In other words, the accusative prepositions typically refer to an action or movement to another place, whereas the dative prepositions refer to something that is not changing location.   Think about the English phrases he jumps into the water versus he is swimming in the water. The first answers a where to question: Where is he jumping? Into the water. Or in German, in das Wasser  or  ins Wasser. He is changing location by moving from the land into the water. The second phrase represents a where situation. Where is ​he swimming? In the water. In German, in dem Wasser  or  im Wasser. He is swimming inside the body of water and not moving in and out of that one location.   To express the two different situations, English uses two different prepositions:  in  or  into. To express the same idea, German uses one preposition -   in  - followed by either the accusative case (motion) or the dative (location). More About Using the Accusative Case If you want to convey a direction or destination in a sentence, youll need to use the accusative. These sentences will always answer the question where  to/wohin? ÃÅ"ber den Film. | What are they talking about? About the film. More About Using the Dative Case The dative case is used to indicate a stable position or situation. It answers the question where/wo?  For example: Die Katze sitzt auf dem Stuhl. (The cat sits on the chair.) The dative is also used when there is no particular direction or goal intended.  For example: Sie ist die ganze Zeit in der Stadt herumgefahren.|  (She drove around town all day.) Remember that the above rules apply only to dual prepositions. Dative-only prepositions will always remain dative, even if the sentence indicates motion or direction.  Likewise, accusative-only prepositions will always remain accusative, even if no motion is described in the sentence.   Clever Ways to Remember  German Prepositions Arrow verses Blob Some find it easier to remember the accusative-versus-dative rule by thinking of the accusative   letter  A  on its side, representing an arrow ( ) for motion in a specific direction, and the dative letter D  on its side to represent a blob at rest. Wo  or  wohin?   If you think that  in der Kirche  is dative and the phrase answers the question  wo?  then you are correct.  In der Kirche  means in (inside) the church, while  in die Kirche  means into the church (wohin?). Now you see yet another reason why you need to know your German genders. Knowing that church is  die Kirche, which changes to  der Kirche  in the dative case, is an essential element in using any preposition, but especially the two-way ones. Down’s syndrome is a genetic disorder that was named after John Langdon Down, the doctor who first recognised it as a distinct condition in 1866.Down’s syndrome affects a babys normal physical development and causes moderate to severe learning difficulties. It is a lifelong condition that develops when a baby is still in the womb (uterus). Children who are born with Down’s syndrome also have a higher chance of developing other conditions, some of which are life threatening. The physical features and medical problems associated with Down’s syndrome can vary widely from child to child. While some children with Down’s syndrome need a lot of medical attention, others lead healthy lives. Though Down’s syndrome cant be prevented, it can be detected before a child is born. The health problems that may go along with Down’s syndrome can be treated, and many resources are available to help children and their families who are living with the condition. It is uncommon in the UK, for example, from 2007 to 2008, 1,843 cases of Down’s syndrome were diagnosed during pregnancy, and 743 babies were born with the condition. Down’s syndrome affects about 1 in every 1,000 live births. Down’s syndrome affects all ethnic groups equally. Boys are slightly more likely (around 15%) to be born with Down’s syndrome than girls. There are estimated to be over 100 characteristics of Down’s syndrome. Common characteristics of Down syndrome can include: †¢ A flat facial profile †¢ An upward slant to the eye †¢ A short neck †¢ Abnormally shaped ears †¢ White spots on the iris of the eye (called Brushfield spots) †¢ A single, deep transverse crease on the palm of the hand †¢ Smaller than average size †¢ Exaggerated space between the first and second toe †¢ Poor muscle tone (called hypotonia) †¢ Joint looseness †¢ Broad feet with short toes †¢ Learning disabilities. Antenatal screening cannot diagnose conditions such as Down’s syndrome, but it can determine the likelihood of the baby developing the syndrome. If the risk of Down’s syndrome (or any other condition) is shown to be high, further testing can be arranged to confirm whether or not the baby has the condition. The test that is used for Down’s syndrome is a combined blood test and an ultrasound scan, which is known as the ‘combined test’. During a blood test, a sample of your blood will be taken and tested to check the levels of certain proteins and hormones. If the blood contains abnormal levels of these substances, one may have an increased risk of having a baby with Down’s syndrome. However, there are treatments and therapies for the physical, medical and cognitive problems associated with Down syndrome. †¢ Medications can be used to treat certain conditions that occur in people with Down’s syndrome. For example, if a person with Down syndrome has a seizure disorder, they would benefit from taking anti-seizure medications. †¢ The baby’s pediatrician will be the main person managing the infant’s health issues. Most pediatricians have experience dealing with the common medical issues seen in children with Down’s syndrome. †¢ Children with Down syndrome are almost always referred to early intervention programs shortly after birth. Early intervention is a program of therapies, exercises and activities designed to specifically help children with Down syndrome or other disabilities. †¢ Physical therapy focuses on motor development. Since most children with Down’s syndrome have hypotonia or low muscle tone, the goal of physical therapy is to teach the children with Down’s syndrome to move their bodies in appropriate ways, and to improve their muscle tone. †¢ Speech therapy is a very important treatment for children with Down’s syndrome. Because children with Down’s syndrome often have small mouths and slightly enlarged tongues, they can have articulation problems. Long term effects- physically Common Down’s syndrome physical effects can include thyroid problems, hearing problems, congenital heart disease, eye problems, joint and muscle problems, Seizure, bone, Leukaemia and other cancers, Immune system problems. Other prominent characteristics of Down syndrome are: a flattened nose, protruding tongue, upward slanting eyes, short hands and fingers, and a single crease in the palm. Some people with Down’s syndrome may have to wear glasses or eye patches. Children with Down’s syndrome can and do learn, and are capable of developing skills throughout their lives. They simply reach goals at a different pace. There is often a misconception that individuals with Down’s syndrome have a â€Å"static† or predetermined ability to learn. This simply is not true. It is now known that individuals with Down’s syndrome develop over the course of their lifetime and should be treated accordingly. The learning potential of an individual with Down’s syndrome can be maximised through early intervention, good education, higher expectations and encouragement. If the child with Down’s syndrome does not have a hearing loss we expect the child’s ability to develop speech to be somewhat dependent on the level of intellectual ability. Therefore, if the child has only a mild intellectual disability (and no hearing loss) he or she usually develops a great deal of speech and can have a simple conversation with family or friends. That’s not to say that people with Down’s syndrome are shy or unsociable, but just may have less confidence in certain years of their lives. Some people with Down’s syndrome may have to be supervised because of their condition, leaving them less outgoing and feeling uncomfortable having an adult watching over them. My second cause of additional need that i now intend to discuss is cerebral palsy Cerebral palsy is a general term covering a number of neurological conditions that affect a childs movement and coordination. Neurological conditions affect the brain and nervous system. Cerebral palsy is caused by damage to the brain, which normally occurs before, during or soon after birth. Known possible causes of cerebral palsy include: †¢ Infection in early pregnancy †¢ A difficult or premature birth †¢ Bleeding in the baby’s brain †¢ Abnormal brain development in the baby (http://www.nhs.uk) At some point very early in life, either while a baby is still growing in the womb, during birth or shortly after, something happens to interfere with the normal development of the brain or to injure the brain tissues. This abnormal development or injury disrupts the nerve signals between the brain and the muscles, leading to problems with movement, posture and coordination as the child grows up. This is called cerebral palsy. While some people are severely affected, others have only minor disruption, depending on which parts of the brain are not functioning properly. It’s estimated that as many as 1 in every 400 children may have cerebral palsy, which means nearly 2,000 babies, from all social backgrounds and ethnic groups, are diagnosed every year. (http://www.bbc.co.uk) About 1 in 500 babies born in the UK have cerebral palsy. The number of cases per year (the incidence) has not changed much over the period of 50 years or so. The health and care of mothers have improved in this time and some causes of cerebral palsy have decreased. However, more babies are being born prematurely and surviving. A proportion of these will have cerebral palsy. This (together with the cause in most cases not being known) is probably why the number of cases has not changed much over the period of 50 years or so. Cerebral palsy is often classified into different types depending on the type of symptoms, which in turn probably reflect which parts of the brain are not working as they should. These include: †¢ Spastic cerebral palsy (about 70 per cent of all cases) some of the muscles in the body are tight, stiff and weak, drawing the limbs in and making control of movement difficult. †¢ Athetoid (dyskinetic) cerebral palsy (10 per cent of cases) control of muscles is disrupted by spontaneous and unwanted irregular writhing movements. These may be the result of muscles changing very rapidly from being loose and floppy to very tight and tense. The muscles used for speech may also be affected, interfering with communication. Control of posture is also disrupted. †¢ Ataxic cerebral palsy problems include difficulty with balance, shaky movements of hands or feet, and difficulty with speech. †¢ Mixed cerebral palsy a combination of two or more of the above. In coordination of the muscles of the mouth may cause feeding problems such as slow feeding, gagging and vomiting. There may be delayed motor milestones, such as crawling and walking, weakness or paralysis of the l imbs, an abnormal gait and slowness in developing speech and social skills. As many as one in three children and adolescents with cerebral palsy also has epilepsy (or seizures). Other common problems include: †¢ Difficulty with walking, writing, eating, talking, dressing †¢ Problems with balance and coordination †¢ Difficulty controlling and maintaining posture (they may need help to sit upright) †¢ Visual difficulties †¢ Hearing problems (http://www.bbc.co.uk) The symptoms of cerebral palsy normally become apparent during the first three years of your childs life. Your child may be slower in achieving important developmental goals, such as learning to crawl, walk or speak. Children with cerebral palsy also tend to have problems with their muscle tone (the unconscious ability to contract or relax muscles as needed). Your child may have: †¢ Hypertonia: increased muscle tone, which can make them appear stiff or rigid †¢ Hypotonia: decreased muscle tone, which makes them appear floppy (http://www.nhs.uk) The diagnosis The paediatrician will ask about a childs history and their pattern of development. They will also study a childs reflexes, posture, motor skills and muscle tone. Depending on the childs age, they may also be referred to an educational psychologist so the childs intellectual development can be assessed. Further tests may be recommended to rule out other conditions, which cause similar symptoms to cerebral palsy, such as a tumour or muscular dystrophy (a genetic condition affecting the development of the muscles). In some cases, further testing will also be able to confirm a diagnosis of cerebral palsy. This is because the condition can cause changes to the structure of the brain, which can be detected by the tests. Tests a child may require include: †¢ Blood tests †¢ Cranial ultrasound, which uses sound waves to build up a picture of the childs brain tissue †¢ MRI scan, which uses radio and magnetic waves to study the brain in more detail †¢ CT scan, which uses a series of X-rays that are then assembled by a computer to create a detailed 3-D model of a childs brain While a confident diagnosis of cerebral palsy can usually be made when s child is two or three years old, the type and severity of a childs cerebral palsy may not be determined until they reach four or five years of age. However, there are plenty of treatments and therapies that can reduce the impact of the condition by easing symptoms such as spasticity, improving communication skills and finding other ways to do things. Physiotherapy, occupational therapy and speech therapy can all play an important part. Children with cerebral palsy do best when they get special help from an early age. Because the brain changes a lot during the first few years of life, it can be difficult to assess the extent of cerebral palsy at first, but most experts suggest babies should be first assessed at about 9 to 12 months. Many children with cerebral palsy benefit from an approach known as conductive education, which helps them to overcome movement problems and gain some control through special education and rehabilitation. Adults can get a lot from it too. Speech and language therapy helps with speech development and also with eating, drinking, and swallowing. Surgery is sometimes needed to correct any deformities that develop as a result of abnormal muscle development or function. Medication can reduce muscle hyperactivity and spasticity, but physiotherapy is the bedrock of cerebral palsy management and can helps with posture and movement. It also tries to prevent progression of disability. Occupational therapy helps children overcome difficulties performing everyday tasks, encouraging them to lead independent lives. With help, most people with cerebral palsy are able to live much the same sort of lives as everyone else. Charlie's Attempt to Overcome the Past in Fitzgerald's Babylon Revisited Babylon Revisited is made up of different characters with different ideologies in life. The Protagonist, Charlie is a reformed alcoholic who had come back to take his daughter. Marion is Charlie's sister- in - law who dislikes him because she thinks he caused her sister's death. I think Marion is emotionally disturbed. She overacts to things that happen in everyday life. Lincoln is Marion's husband .He tries to keep things as even as possible for Marion. Loraine and Duncan are ghosts from Charlie's past and they came to haunt him at the end of the story. We are always being haunted by our past sins and Misdemeanors. Even when we have been reformed, it takes a similar incident or someone appearing from the past to remind us of what we were before. I think Charlie is a strong Character. He was able to reform himself and stop drinking. This shows that he is strong. His coming back for his daughter proves that he is aware of his Civic responsibilities and he is ready to undertake them. There is a Strong bond between him and his daughter which is definitely a plus on his side. Charlie's journey to Paris to pick up his daughter reminds me of when I visited America. I stayed for one year before I went back for my Children. I had to get to know them again. I can relate to Charlie when he told Honoria "I want to get to Know you" (9).When you stay away from you children for sometime , you feel that they have grown so much and there is so much you don't know about them. Charlie had reasons to mistrust Marion .As Fitzgerald put it " Charlie became increasingly alarmed at leaving Honoria in this atmosphere of hostility against himself; sooner or later, it will come out in a word here, a shake of head there, and some of the distrust will be irrevocably implanted on Honoria"(13). It is not easy to leave your child with some one who you Know definitely does not like you. The father and Daughter bond is a strong bond and if it is destroyed at this early age it can become very difficult to restore it. Marion was very strongly biased against Charlie. Marion was ready to give Honoria back to the father until the appearance of Duncan and Lorraine.

Napoleon Bonaparte, a Man of War

Napoleon Bonaparte rise to power was because of his strong army he formed and his strategy for winning wars however his fall came when he went to Russia intending to defeat them but lost. Napoleon’s policies were to ensure freedom and equality for the people and to give the people the education they needed. Napoleon Bonaparte was born Napoleone di Buonaparte in Corsica, August 15, 1769. He was a small child, and often was teased by his classmates when he was enrolled in military college at a very early age in 1777, and it is believed that this influenced the determination he had to win later in life.Later, he went to Ecole Militaire (also known as military school) from 1784 to 1785. Also in 1785, he graduated with the rank of second lieutenant. Great things were expected of Napoleon. However, no one could have guessed that he would go on to make history. Napoleon was a rising star in the French military. A general at the age of 27, he had won the admiration of France thanks to his leadership, military talents, and personal talents. Yet his talents lay not in originality but in his stunningly innovative adaptations of military strategies and tactics developed in the eighteenth century and during the Revolution.While in the military, he won many battles over Austria. In 1795, the people of France tired of the Reign of Terror, revolted, executing many leaders of the Terror. The Directory took power. On Napoleon's return to France, he found that many people were very dissatisfied with the Directory. With the support of his troops, he overthrew them and became France's new dictator, naming himself First Consul for life. The votes of the public approved of this move. He was determined to succeed in life. His first real military action was a great success.He was captain of artillery during the siege of Toulon, where he captured several important strongholds, and forced the retreat of British naval fleets. He became Brigadier General while campaigning in Italy, but was arrested and jailed there for being an associate of the brother of the executed Maxamillion Robespierre. After getting out of jail, he continued on to achieve even more military greatness. Napoleon strategy in winning wars was brilliant. When he confronted an army stretched out before him, skilled marksmen threw the opponent’s advance forces into disarray and assessed the opposing army’s weakest point.The concentration of deadly artillery fire- Napoleon once referred to the twelve-pound cannons as his beautiful daughters-prepared the war for the assault of the infantry columns. The speed of his army’s movement was such that he could rapidly attack and defeat part of an enemy army before reinforcements could arrive. Napoleon’s genius was his ability to organize, oversee and assure the supplying of and communication between larger armies than had ever before been effectively assembled, and to move them more rapidly than anyone before him. All of his success earned him a dictator of France.As a dictator Napoleon made many reforms to France. Napoleon was influenced by the Enlightenment which made him believe that the church should not have an institutional role in the affairs of state. He said that society cannot exist without some being richer than others and this inequality cannot exist without religion. No papal bull could be read in France’s church without permission of the government; the clergy would have to read official government decrees from the pulpit. Under Napoleon, the church gained the freedom of religious practice, but at the expense of some of its independence.Napoleon also gave freedom of religion. Napoleon granted Protestants and Jews state protection to practice their religion. An article of the concordat guaranteed freedom of worship for people in both religions. Also Napoleon created a new social hierarchy based not on blood but on service to the state, particularly in the army and bureaucracy and on ownership of property. Napoleon also established the Bank of France in 1800 which facilitated the state’s ability to borrow money. He followed the Directory’s policy of abandoning the grossly inflated paper money of the Revolution, which stabilized France’s currency.He facilitated the assessment and collection of taxes, ordering a land survey of the entire country upon which direct taxes were to be based. And he expanded the number of indirect taxes collected on salt, tobacco, and liquor, as well as on goods brought into any town of over 5,000 inhabitants. Education also became a huge priority for Napoleon because in a country in which about half the population was illiterate, he believed that schools could create patriotic and obedient citizens through teaching secular values that would ultimately link education to nationalism.In 1802, Napoleon established state secondary schools called lycees, thirty-seven of which were operating six years later, for the rela tively few boys who went beyond primary school. Students read only textbooks approved by the emperor and in 1808, he created France’s first public university system. Education became seen as a value in itself, as well as a means of social ascension. After a while, Napoleon created the Napoleonic Code. This code made the rights of property owners sacrosanct. The code, over 2000 articles long, enshrined the equality of all people before the law and the freedom of religion.The subsequent Penal Code of 1810 proclaimed the freedom to work that forbade associations of workers’ associations. Many of the policies had positive effects on the country however they had negative side effects on the people and the economy. Great Britain alone was one of the strongest forces in the defeat of Napoleon. On land, Napoleon was successful against the British, but on sea the British controlled every estuary. Great Britain also created the Orders of Council, which ordered neutral nations no t to trade with France.This was much more effective than Napoleon’s Continental System because Great Britain controlled the seas. Napoleon had many problems that were unrelated to the Quadruple Alliance. When he issued the Decrees of Berlin and Milan, Portugal was not happy because they wanted to trade with Britain. To subdue Portugal, French troops had to cross Spain. Soon troops were forced to occupy Spain as well as Portugal. When the Spanish revolted, Napoleon appointed his brother Joseph as Monarch. The Spanish found this to be very disrespectful to have a foreign ruler appointed, and thus fought with even greater passion and desire.Assisting the Spaniards in ultimately freeing themselves from Napoleon’s control was the English army under the command of Arthur. Wellesley was later made the Duke of Wellington, where he would take an even more major role in Napoleon’s defeat. This war with Spain, based on a rise of nationalism, was the beginning of the end fo r Napoleon. There were also many more problems with rebellions by Austria and Russia. Alexander I of Russia broke his Alliance with Napoleon, due to Russia’s failing economy. This led to Napoleon suffering what is considered to be his worst defeat ever when he went to war with Russia.This defeat was largely due to the French being pushed by the Russians towards the torched city of Moscow. Here they froze, starved or were killed in battle. This defeat encouraged other countries to try for victory. Although allied nations did combine to inflict another defeat for Napoleon at the battle of Leipzig in 1813, it must be noted that the Quadruple Alliance was not officially established at this time and there were many other influences that led to Napoleon’s decline. Napoleon’s defeat at the Battle of Waterloo was not determined because of he Quadruple Alliance, but rather it was due to tactical mistakes on behalf of Napoleon. Napoleon made the mistake of entrusting his armies to inferior generals such as Ney, who had no real education, and Marshal Emmanuel de Grouchy, who lacked the charismatic spirit that Napoleon’s men needed before battle. He also made the mistake of underestimating his opponents. Napoleon’s health was also to blame for his defeat. At Waterloo he suffered an array of aliments such as stomach pains, and pneumonia. His actions were sluggish; he was slow in issuing commands, and responding to messages.While Napoleon misjudged his opponents, Wellington did not. Wellington had fought against Napoleon before, and was a master of defensive tactics. Ney made many mistakes in the battle, his worst being sending his cavalry to attack hastily, unsupported by infantry. They were slaughtered within minutes. Despite the surprise attack by the Prussians and organization of the Quadruple Alliance helping defeat Napoleon at Waterloo, the British would still have defeated Napoleon due to his own personal doubts, faults and downfall .In conclusion, Napoleon’s rise to power was clouded his mind that he failed to realize the possibilities of defeat. Napoleon was lethargic and this was the reason why he fell from power. However, Napoleon can be seen as a great lieutenant. His military talents led him to many victories. His victories led him to become a dictator of France who influenced the French. Napoleon was a strong man and despite his ambiguity, he is considered a man of war.

The Blackstone Commentaries and Women's Right In the 19th century, American and British womens rights- or lack of them- depended heavily on the commentaries of William Blackstone which defined a married woman and man as one person under the law. Heres what William Blackstone wrote in 1765: By marriage, the husband and wife are one person in law: that is, the very being or legal existence of the woman is suspended during the marriage, or at least is incorporated and consolidated into that of the husband; under whose wing, protection, and cover, she performs every thing; and is therefore called in our law-French a feme-covert, foemina viro co-operta; is said to be covert-baron, or under the protection and influence of her husband, her baron, or lord; and her condition during her marriage is called her coverture. Upon this principle, of a union of person in husband and wife, depend almost all the legal rights, duties, and disabilities, that either of them acquire by the marriage. I speak not at present of the rights of property, but of such as are merely personal. For this reason, a man cannot grant anything to his wife, or enter into covenant with her: for the grant would be to suppose her separate existence; and to covenant with her, would be only to covenant with hims elf: and therefore it is also generally true, that all compacts made between husband and wife, when single, are voided by the intermarriage. A woman indeed may be attorney for her husband; for that implies no separation from, but is rather a representation of, her lord. And a husband may also bequeath any thing to his wife by will; for that cannot take effect till the coverture is determined by his death. The husband is bound to provide his wife with necessaries by law, as much as himself; and, if she contracts debts for them, he is obliged to pay them; but for anything besides necessaries he is not chargeable. Also if a wife elopes, and lives with another man, the husband is not chargeable even for necessaries; at least if the person who furnishes them is sufficiently apprized of her elopement. If the wife be indebted before marriage, the husband is bound afterwards to pay the debt; for he has adopted her and her circumstances together. If the wife be injured in her person or her p roperty, she can bring no action for redress without her husbands concurrence, and in his name, as well as her own: neither can she be sued without making the husband a defendant. There is indeed one case where the wife shall sue and be sued as a feme sole, viz. where the husband has abjured the realm, or is banished, for then he is dead in law; and the husband being thus disabled to sue for or defend the wife, it would be most unreasonable if she had no remedy, or could make no defence at all. In criminal prosecutions, it is true, the wife may be indicted and punished separately; for the union is only a civil union. But in trials of any sort they are not allowed to be evidence for, or against, each other: partly because it is impossible their testimony should be indifferent, but principally because of the union of person; and therefore, if they were admitted to be witness for each other, they would contradict one maxim of law, nemo in propria causa testis esse debet; and if against each other, they would contradict another maxim, nemo tenetur seipsum accusare. But, where the offence is directly against the person of the wife, this rule has been usually dispensed with; and therefore, by statute 3 Hen. VII, c. 2, in case a woman be forcibly taken away, and married, she may be a witness against such her husband, in order to convict him of felony. For in this case she can with no propriety be reckoned his wife; because a main ingredient, her consent, was wanting to the contract: and also there is another maxim of law, that no man shall take advantage of his own wrong; which the ravisher here would do, if, by forcibly marrying a woman, he could prevent her from being a witness, who is perhaps the only witness to that very fact. In the civil law the husband and the wife are considered as two distinct persons, and may have separate estates, contracts, debts, and injuries; and therefore in our ecclesiastical courts, a woman may sue and be sued without her husband. But though our law in general considers man and wife as one person, yet there are some instances in which she is separately considered; as inferior to him, and acting by his compulsion. And therefore any deeds executed, and acts done, by her, during her coverture, are void; except it be a fine, or the like manner of record, in which case she must be solely and secretly examined, to learn if her act be voluntary. She cannot by will devise lands to her husband, unless under special circumstances; for at the time of making it she is supposed to be under his coercion. And in some felonies, and other inferior crimes, committed by her through constraint of her husband, the law excuses her: but this extends not to treason or murder. The husband also, by the old law, might give his wife moderate correction. For, as he is to answer for her misbehaviour, the law thought it reasonable to intrust him with this power of restraining her, by domestic chastisement, in the same moderation that a man is allowed to correct his apprentices or children; for whom the master or parent is also liable in some cases to answer. But this power of correction was confined within reasonable bounds, and the husband was prohibited from using any violence to his wife, aliter quam ad virum, ex causa regiminis et castigationis uxoris suae, licite et rationabiliter pertinet. The civil law gave the husband the same, or a larger, authority over his wife: allowing him, for some misdemeanors, flagellis et fustibus acriter verberare uxorem; for others, only modicam castigationem adhibere. But with us, in the politer reign of Charles the second, this power of correction began to be doubted; and a wife may now have security of the peace against he r husband; or, in return, a husband against his wife. Yet the lower rank of people, who were always fond of the old common law, still claim and exert their ancient privilege: and the courts of law will still permit a husband to restrain a wife of her liberty, in the case of any gross misbehaviour. These are the chief legal effects of marriage during the coverture; upon which we may observe, that even the disabilities which the wife lies under are for the most part intended for her protection and benefit: so great a favourite is the female sex of the laws of England.
